By accessing or using LoudCheck, you confirm that you have read, understood and agree to these Terms and Conditions.

If you do not agree with these Terms, you should not use LoudCheck.

These Terms apply whether you use LoudCheck for personal, professional, educational or commercial purposes.

LoudCheck is available to users generally, subject to these Terms and any applicable law.

You are responsible for ensuring that your use of LoudCheck is lawful in the jurisdiction in which you access the Service.

You must provide accurate information when creating an account and must not create an account using false or misleading information.

LoudCheck provides automated audio analysis designed to help users understand measurable characteristics of an audio file before distribution or further professional review.

The Service may include measurements such as loudness, true peak, loudness range, peak-to- loudness ratio, RMS, stereo balance, spectral information, clipping indicators and other measurements described in the LoudCheck methodology.

LoudCheck may also provide risk indicators, readiness assessments, recommendations, simulations and other analytical outputs.

ELTY may modify, improve, add or remove features from LoudCheck from time to time.

Uploaded audio files are processed for the purpose of performing the requested LoudCheck analysis.

LoudCheck does not permanently store uploaded audio files.

Audio files are deleted after the analysis process in accordance with the Service's technical processing workflow.

Uploaded audio files are not used by ELTY to train artificial intelligence or machine learning models.

ELTY does not intentionally share uploaded audio files with third parties.

LoudCheck analysis results are generated automatically from the measurements obtained from the uploaded audio.

Analysis results may include measurements, classifications, risk indicators, readiness assessments, confidence scores and recommendations.

LoudCheck does not guarantee that an analysis result is correct for every possible playback environment, distribution platform or professional application.

Users remain responsible for reviewing their results and applying appropriate professional judgment.

LoudCheck uses a documented methodology for measuring and interpreting audio characteristics.

The methodology may include objective audio measurements, reference ranges, risk rules, classifications, simulations, scoring and readiness assessments.

The methodology may be revised over time. A change to the methodology may affect the assessment produced for an audio file.

The current methodology documentation is available through the LoudCheck website.

References to professional audio standards, AES concepts, broadcast practice or streaming practices do not mean that LoudCheck is certified, endorsed or approved by those organizations unless explicitly stated.

Payments for LoudCheck services are processed through Paystack.

Payment processing may be subject to Paystack's own terms, policies and security procedures.

ELTY does not request or intentionally store complete payment-card details through LoudCheck.

Access to paid functionality is dependent on successful payment and the applicable plan or purchase.

Unless otherwise stated, LoudCheck and its underlying technology are owned or controlled by ELTY.

This includes, where applicable:

• LoudCheck software and source code.
• LoudCheck methodology.
• Audio analysis algorithms and rules.
• Assessment logic and scoring systems.
• LoudCheck reports and report structures.
• LoudCheck branding, names, logos and visual identity.
• Website content and documentation.

You may not copy, reproduce, reverse engineer, modify, redistribute, resell or commercially exploit LoudCheck or its underlying technology except where expressly permitted by ELTY or applicable law.

LoudCheck may depend on third-party services to provide parts of its functionality.

Current service providers may include:

• Clerk — account and authentication services.
• Paystack — payment processing.
• Railway — infrastructure and application hosting.

Third-party services may have their own terms, privacy policies and technical limitations.

ELTY may replace or introduce service providers where reasonably necessary to operate or improve LoudCheck.

ELTY aims to keep LoudCheck available and operational but does not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, upgrades, infrastructure failures, network problems, security incidents, third-party service failures or circumstances beyond ELTY's reasonable control.

ELTY may suspend or terminate access to LoudCheck where reasonably necessary to protect the Service, its users or ELTY.

This may include circumstances involving:

• Abuse of the Service.
• Fraudulent activity.
• Illegal activity.
• Attempts to compromise the Service or its infrastructure.
• Payment abuse or unresolved payment issues.
• Material violation of these Terms.

Where appropriate and reasonably possible, ELTY may provide notice before termination.

To the extent permitted by applicable law, ELTY will not be responsible for losses arising solely from a user's interpretation or use of LoudCheck analysis results where those results are used contrary to the limitations and recommendations described by the Service.

Users should maintain their own backups of original audio files and other important materials.

Nothing in these Terms is intended to exclude, restrict or limit liability or consumer rights where doing so would be unlawful under applicable South African law.

You are responsible for deciding how to act on the information produced by LoudCheck.

You should independently review important audio decisions before distribution or commercial release.

You are responsible for ensuring that your uploaded audio does not infringe the rights of another person or organization.

Your use of LoudCheck may involve the processing of personal information, including information associated with your account.

Information about how personal information is handled is provided in the LoudCheck Privacy Policy.

You should read the Privacy Policy together with these Terms.

ELTY may update these Terms from time to time to reflect changes to LoudCheck, its business, applicable requirements or the Service.

The updated version will be published on the LoudCheck website with a revised effective date where appropriate.

Your continued use of LoudCheck after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
