LoudCheck is an audio analysis service operated by ELTY in South Africa.

LoudCheck uses Clerk to provide account registration, authentication and related account-management functionality.

Authentication-related information may therefore be processed by Clerk in accordance with its own privacy practices and policies.

LoudCheck does not operate as the underlying authentication provider.

Payments for LoudCheck services are processed by Paystack.

ELTY/LoudCheck does not store users' complete card or banking details.

Payment information is handled by Paystack in accordance with Paystack's applicable privacy, security and payment-processing policies.

Information relating to a transaction may still be received or processed by LoudCheck where necessary to identify the transaction, provide purchased services, manage account access or maintain appropriate business records.

LoudCheck does not currently store completed audio analysis results in its database.

The analysis is performed to provide the requested service and the resulting information is returned to the user as part of that analysis process.

Information may be used where necessary to:

• Create and manage your LoudCheck account.
• Authenticate your identity and provide secure account access.
• Process payments and purchased LoudCheck services.
• Perform audio analysis requested by you.
• Provide LoudCheck functionality and support.
• Maintain the security and integrity of the service.
• Detect and investigate fraud, abuse or attempts to compromise the system.
• Comply with applicable legal obligations.
• Resolve disputes and protect legitimate business interests.

LoudCheck does not currently use cookies for advertising, behavioural tracking or analytics.

Third-party services used to provide functionality such as authentication may use their own technical mechanisms as described in their respective policies.

LoudCheck does not currently use Google Analytics, Meta/Facebook Pixel, Microsoft Clarity or another general-purpose visitor analytics platform.

ELTY may use search-engine webmaster services, including Google Search Console and Microsoft/Bing Webmaster tools, to understand how the website is indexed and presented in search engines.

These services are primarily used for website search visibility, indexing and technical diagnostics rather than behavioural advertising.

ELTY does not currently define a fixed retention period for account information.

Account information may be retained while an account remains active and for a reasonable period afterwards where necessary for legitimate business purposes, including legal compliance, accounting, security, fraud prevention, dispute resolution or enforcement of applicable agreements.

Uploaded audio files are treated differently: they are processed for analysis and are deleted after analysis rather than being retained as a permanent audio library.

You retain ownership of the music and audio content you submit to LoudCheck.

Submitting audio to LoudCheck does not transfer ownership of your music or intellectual property to ELTY.

You are responsible for ensuring that you have the necessary rights and permissions to submit audio for analysis.

LoudCheck and its associated intellectual property remain the property of ELTY, subject to any rights belonging to third parties.

This includes, among other things:

• LoudCheck software
• Methodology
• Algorithms
• System design
• Reports and report formats
• Branding and trademarks
• Website design and content

ELTY takes reasonable measures intended to protect information processed through LoudCheck against unauthorized access, misuse, loss or disclosure.

However, no internet-based service or method of electronic transmission can be guaranteed to be completely secure.

Users should therefore avoid submitting information that is unnecessary for the requested analysis.

Depending on the circumstances and applicable law, you may request access to, correction of, deletion of or other appropriate action concerning personal information held by ELTY.

ELTY may need to verify the identity of the person making a request before providing or changing personal information.

LoudCheck is intended for general use, but users must comply with applicable age requirements and legal requirements when creating an account and using paid services.

If you believe that personal information belonging to a child has been submitted to LoudCheck in circumstances where it should not have been, please contact us at support@elty.co.za .

Some of the third-party technology providers used by LoudCheck may process information in countries outside South Africa.

Where information is processed through a third-party provider, that provider's applicable terms, privacy practices and security measures may apply.

ELTY may update this Privacy Policy from time to time to reflect changes to LoudCheck, applicable legal requirements, technology or data-processing practices.

When material changes are made, the updated policy will be published on this page with a revised effective date.
